^^^ This is true. Tax the gains and limit the losses.
In fact, taxing unrealized gains already occurs with section 1256 contracts and straddles.

And also with AMT, which taxes unrealized gains on incentive stock options. A lot of people got royally screwed for tax year 2000 when they exercised their ISOs and the market crashed before they sold the stock. They were taxed on the gain in the year of exercise, and after the market crashed selling all of the stock wouldn't cover the taxes. A bunch of high-tech workers had a net loss of more than $100k, of the tax due vs. what they could sell the stock for. (For some bigwigs the net loss was in the millions). Congress changed the law a bit in 2006 to allow the net loss to be recovered in some cases, but it's still a trap that can tax unrealized gains with the taxpayer ultimately having a net loss,
